In Canada you can transmit whatever the hell you want!. In the US I
don't think the FCC really cares about people using digital modes.
Hearsay has it that they care more about people using linear amplifiers.
RAC does have a bandplan, but it's only as official as they are. ;) I've yet (in my limited experience) to encounter anybody complaining about others not following said plan, however I do hear a lot of that sort of chatter coming from the US. The Ontario Swap Shop net sometimes gets chewed out by US hams for "transmitting on the CW portion of the band" on 40 meters, where IIRC they meet on 7.055 on Sunday mornings.
I'm pretty sure the RAC bandplan is more or less a mirror of the FCC's. Following it isn't necessary, but it keeps things running smoothly if you do.
